EHRC response to European Commission's questionnaire on equal pay

Response to European Commission's questionnaire on implementation of European equal pay law principles in domestic law

18 January 2013

In accordance with Article 32 of Directive 2006/54/EC of Parliament and of the Council of 5 July 2006 on the implementation of the principle of equal opportunities and equal treatment of men and women in matters of employment and occupation (recast) the European Commission is planning to draw up a report to the European Parliament and the Council on the application of the Directive, reviewing the operation of this Directive with a specific focus on the application of the principle of equal pay in practice.

The European Commission sent out questionnaires to European gender equality bodies for information on the application of the provisions on equal pay, enshrined in Article 4 of the Directive. They were particularly interested in implementation of the EU provisions on equal pay in practice each Member State and the definition of 'work of equal value' in national law as well as regulation concerning job classification/evaluation systems in the UK.

The information concerning the national gender equality bodies will be particularly relevant to the forthcoming report due to important role of equality bodies. In preparation for the Report of the Directive 2006/54/EC, the European Commission has launched a consultation with the Member States in July 2012. The information received from the network of gender equality bodies on the application of equal pay in practice will be an additional valuable asset and would very much help the European Commission in drafting the report.
