Immigration Bill, House of Commons, Second Reading, 13 October 2015

The Commission welcomes the provisions in the Immigration Bill designed to tackle illegal working and enhance the enforcement of labour market rules. However we do have a number of concerns about Parts 2 and 4, and Schedule 6 of the Bill with regard to compliance with the European Convention on Human Rights (ECHR) and the UN Convention on the Rights of the Child (UNCRC).

The Commission also believes that if the overarching impact assessment included consideration of the equality impact required by s149 of the Equality Act, this would be significant in assisting Parliamentarians to fully understand and debate the different provisions contained within the Bill.

Our view is that the way in which the changes are proposed could have the unintended consequence of undermining the Government’s policy intention and potentially damage progress made on other issues, such as stop and search.
