Briefing in support of Earl Howe’s amendment to the Care Bill

The Commission welcomes Earl Howe’s amendment to the Care Bill that would introduce a revised version of Clause 48 into the Bill.

The amendment would clarify the scope of the Human Rights Act 1998 for people using registered social care providers, covering care and support when it is arranged or paid for (directly or indirectly) by a public authority.

The effect of the amendment would be to guarantee a right of redress for victims of human rights breaches in social care settings and, in the Commission’s analysis, help to raise standards in the sector by embedding a culture of human rights.

In 2011, the report of the Commission's ‘Close to home’ inquiry into older people and human rights in home care found worrying evidence of human rights breaches. The report drew attention to the human rights protection gap in this sector and recommended that the law be clarified.
